Welcome to the Women’s Elite Rugby (“WER”) online shop. These Terms of Service (“Terms”) explain how you may access and use our website and purchase products from us.

By accessing or using our site, or by placing an order, you agree to be bound by these Terms and by any policies we reference (including our Shipping & Exchange Policy and Privacy Policy). If you do not agree, please do not use the site.

1. Who we are

2. Eligibility

By using this site, you confirm that:

  1. You are at least 18 years old, or using the site under the supervision of a parent or legal guardian, and

  2. You have the authority to enter into a binding agreement with us.

3. Online store terms

You agree not to use our site or products:

  • For any unlawful purpose

  • To violate any applicable laws or regulations

  • To infringe upon our intellectual property rights or those of others

  • To introduce malicious code, attempt to hack, or disrupt the site’s operation

We may refuse service, cancel orders, or limit quantities at our discretion if we believe a violation has occurred.

4. Account information

You may be able to create an account on our site. You are responsible for:

  • Keeping your login details confidential

  • All activity that occurs under your account

Please let us know right away if you suspect unauthorized use of your account.

5. Products and availability

  1. Made-to-order products
    Many or all items are custom or made-to-order. Please review the product description and our Shipping & Exchange Policy before purchasing.

  2. Accuracy of descriptions
    We try to describe and photograph products accurately, but minor variations in color, size, or design may occur. These minor differences do not constitute defects.

  3. Availability
    Products and sizes may be limited in quantity. We may discontinue products or change them at any time without prior notice.

6. Pricing and payment

  1. Prices

    • All prices are shown in US dollars (USD) unless stated otherwise.

    • Prices may change at any time, but changes will not affect orders we have already accepted.

  2. Taxes and fees

    • Applicable sales taxes will be calculated at checkout based on your shipping address.

    • You are responsible for any taxes, duties, or fees that apply to your order.

  3. Payment methods
    We accept the payment methods shown at checkout (for example: major credit/debit cards, Shop Pay, PayPal, etc.). By submitting payment information, you represent that you are authorized to use that payment method.

  4. Errors
    If there is an error in pricing or product information, we may cancel the order or contact you to confirm whether you wish to proceed.

7. Orders and acceptance

  1. Order process
    Your order is an offer to buy products from us. When you place an order, you will receive an order confirmation email. This confirmation acknowledges receipt of your order, it does not guarantee acceptance.

  2. Acceptance
    We accept your order when we either:

    • Charge your payment method and/or

    • Send a shipping confirmation email.

  3. Cancellations or changes by us
    We may cancel or refuse an order if, for example:

    • The product is unavailable

    • We suspect fraud or misuse

    • There is an error in price or description

If this happens after payment is taken, we will issue a refund for the affected items.

  1. Changes by you
    If you need to change or cancel your order, please contact us at inquiries@womenseliterugby.us as soon as possible. We cannot guarantee that changes can be made once production or fulfillment has started.

8. Shipping

  1. Shipping area
    We currently ship to addresses within the United States only. We do not offer international shipping at this time.

  2. Processing and delivery time
    Because many items are custom or made-to-order, please allow approximately 3–4 weeks for processing and shipping. These timeframes are estimates and not guarantees. Delays can occur due to production, carrier issues, or factors outside our control.

  3. Shipping charges
    Shipping fees will be calculated and displayed at checkout.

  4. Risk of loss
    Risk of loss and title for products pass to you when the order is delivered to the shipping address you provide. If a package is marked as delivered by the carrier but you have not received it, please contact the carrier first, then contact us if needed.

9. Exchanges and returns

  1. No returns for refunds
    As a general rule, we do not accept returns for refunds, given the custom and made-to-order nature of our products.

  2. Exchanges
    We may offer exchanges for eligible items as described in our Shipping & Exchange Policy. Typically, items must:

    • Be in their original, unused condition

    • Be returned within 60 days of purchase

    • Include original tags/packaging (if applicable)

  3. Incorrect or defective items
    If you receive an incorrect or defective item, please contact us at inquiries@womenseliterugby.us with your order number and photos, and we will work with you on an appropriate solution in line with our policies.

  4. Policy details
    The specific terms and process for exchanges or defective items are set out in our Shipping & Exchange Policy, which is incorporated into these Terms by reference.

10. Promo codes and discounts

  • Promotional codes, discounts, or offers may be subject to additional terms (such as expiry dates, product exclusions, or usage limits).

  • We may modify, suspend, or withdraw promotions at any time.

11. Intellectual property

  1. Ownership
    All content on this site, including logos, graphics, text, photographs, designs, and software, is owned by or licensed to WER and is protected by copyright, trademark, and other laws.

  2. Limited license
    We grant you a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes. You may not reproduce, copy, sell, or exploit any part of the site or our content without our prior written consent.

12. User content

If the site allows you to submit content (for example, reviews or comments):

  1. You are responsible for any content you submit.

  2. You confirm you have the right to submit that content and that it does not violate any law or the rights of others.

  3. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our site and marketing (for example, showing your review on the product page).

We may remove or edit user content at our discretion.

Our site may include links to third-party websites or may use third-party services (such as payment processors).

  • We are not responsible for the content, policies, or practices of third-party websites or services.

To the fullest extent permitted by law:

  2. We do not guarantee that:

    • The site will be uninterrupted, secure, or error-free

    • Defects will be corrected

    • Information on the site will always be accurate or complete

Nothing in this section is intended to exclude or limit any rights you may have under applicable consumer protection laws that cannot be excluded or limited.

15. Limitation of liability

To the fullest extent permitted by law:

  1. We (and our directors, officers, employees, partners, and agents) will not be liable for any:

    • Indirect, incidental, special, consequential, or punitive damages

    • Loss of profits, revenue, data, or goodwill

  2. Our total liability for any claim arising out of or relating to the site, products, or these Terms will not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

16. Indemnity

You agree to indemnify and hold harmless WER and its officers, directors, employees, partners, and agents from any claim or demand (including reasonable attorneys’ fees) made by a third party arising out of:

  • Your breach of these Terms

  • Your violation of any law or third-party rights

  • Your misuse of the site or products

17. Governing law and dispute resolution

  1. These Terms and any disputes relating to them or to your use of the site or purchase of products will be governed by the laws of Delaware, and the laws of the United States, without regard to conflict of law principles.

  2. You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page.

  • Changes take effect when posted on the site.

  • Your continued use of the site after changes are posted means you accept the updated Terms.
